Welcome to wordpractice.io (“we”, “our”, or “us”). By accessing or using our website and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
2. Account Registration and Security
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activities that occur under your account.
- One Account Policy: Create and maintain only one account per person. Creating multiple accounts is strictly prohibited and may result in suspension or termination of all associated accounts.
We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading.
3. User Conduct
You agree not to engage in any of the following prohibited activities:
- Illegal Activities: Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
- Unauthorized Access: Attempting to access or search the Service or download content from the Service through unauthorized means.
- Multiple Accounts: Creating, operating, or maintaining more than one account per person. This includes creating alternate accounts to circumvent bans, suspensions, or other restrictions.
- Interference: Interfering with, or disrupting, the integrity or performance of the Service.
- Harmful Content: Uploading or transmitting unlawful, defamatory, obscene, or otherwise objectionable content.
- Spam: Sending unauthorized promotional content or spam.
- Impersonation: Misrepresenting your identity or affiliation.
Violation of any of the above may result in immediate termination of your account and access to the Service.
4. User Content
By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform such content in connection with the Service.
You represent and warrant that you have all rights necessary to grant this license.
5. Intellectual Property
All content on the Service is the property of wordpractice.io or its licensors. You may not reproduce, modify, or distribute any part of the Service without our written permission.
6. Privacy
Your use of the Service is subject to our Privacy Policy.
7. Termination
We may suspend or terminate your access at our sole discretion, without notice, for behavior that violates these Terms or is harmful to others or to the Service.
8. Disclaimers
The Service is provided "as is" and without warranties of any kind. We do not guarantee uninterrupted or error-free service.
9. Limitation of Liability
To the fullest extent permitted by law, wordpractice.io shall not be liable for any indirect, incidental, or consequential damages. Our aggregate liability shall not exceed CAD $100 or the amount paid in the last six months.
10. Indemnification
You agree to indemnify and hold harmless wordpractice.io and its affiliates from any claims arising from your use of the Service or violation of these Terms.
11. Modifications to the Service
We may modify or discontinue the Service at any time without notice or liability.
12. Governing Law
These Terms are governed by the laws of Ontario, Canada.
13. Dispute Resolution
13.1. Opt-Out of Arbitration
You may opt out of the arbitration agreement by sending a written notice to [email protected] with the subject line "Arbitration Opt-Out" and including your full name and the email address associated with your account. This notice must be sent within 30 days of your first use of the Service. If you do not opt out within this period, you are deemed to have agreed to the arbitration terms.
Disputes will be resolved by binding arbitration in Toronto, Ontario, Canada, in English, under the rules of the Canadian Arbitration Association.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the revised Terms.
